Licensing and Administrative Representation
Our office handles the defense of professional licensing or investigatory matters involving the Board of Psychology, Board of Registered Nursing, Medical Board, Department of Real Estate, Department of Insurance, and other state or local licensing agencies. Most often, our office is contacted by clients already facing a criminal investigation or criminal charges, and also facing a parallel, or closely related, licensing or administrative investigation. In some limited matters, we will assist clients who are only facing licensing or administrative investigations, without parallel criminal matters pending.
If the licensee is facing criminal charges and a licensing or administrative investigation, it is crucial that the licensee hires legal counsel with the appropriate experience to help them navigate what can be a complex and often confusing process. Criminal cases with licensing consequences for state licensees or public employees will require an attorney well versed in the various licensing agencies and local agencies to help them navigate effectively the process.
Even if you believe you may have violated the law you may have mitigating circumstances that can be raised. Many licensing matters are alcohol or drug related. We can work with you to get you into the appropriate treatment or drug and alcohol facility. We can assist you with finding an appropriate and experienced therapist if you decide to hire our law firm and need that type of support or evaluation of your issues. We can work with you to have you forensically evaluated, by an experienced and licensed psychologist or psychiatrist.
We additionally have experience defending the licensee against Penal Code Section 23 motions brought in criminal court. A Penal Code Section 23 motion is one where the state agency which issued the license can appear in criminal court and recommend interim suspension, or other restrictions on a professional license, if the crime charged is substantially related to the qualifications, functions, or duties of the licensee.
You may have a valid defense to any and all charges. In that case we are prepared to aggressively and effectively advocate on your behalf. Please contact our office today for a free and confidential consultation regarding your criminal law matter, administrative, or licensing matter.
